thats what i meant john, it does say on the CAA form if you paid for flights on cc you need to claim off card company

Yes, but only if direct. If you bought flights off Travel Rep with a card you'd need to claim off Travel Rep (Atol-CAA), not your card, as that's who the card had the agreement with.

all i know is that the form i got off the website said if you have booked flight only either direct or with travel company you can claim off your credit card.

My dad lost his flight with A1Travel last year if he had paid with his credit card he could have claimed off that, but because he paid by debit card he had to go through the CAA, it took me 8 months to get the money back for him

Hi Sue, I know its a real pain - I was involved in the Goldtrail one and that was a nightmare.

The way it was explained to me was:
If the payment was direct with the company that has went bust your credit company is partly to blame as they had an agreement between the two companies to offer a service which couldn't be used.

If the flights were bought through a third party (travel agent), and the travel agent is still trading, that's who the credit card company had an agreement with so there's no blame on there part. It's up to the agent to direct you to their insurance policy or Atol/CAA.

When Goldtrail collapsed, Tesco Finance (mastercard) refused to pay up as we had bought through a travel agency - flights and accomm but seperate bookings.

thats what i was led to believe you had to claim through the travel agents if your flight went bust, but last year my dad claimed with A1 Travel agent only because he paid by debit card if he had paid by credit card he could have gone though cc company, its all very confusing especially when cc companies try to fob you off and say you need to go through CAA like they tried to do with us

I booked direct with Goldtrail last year and paid with credit card and had to claim off the CAA,this time the CAA said to claim off my credit card company if I booked direct with H4U,Ive had my money refunded now.It all depends at the time what the CAA tells you to do,different in both cases !!,if you have booked through an agent for H4U flights or holidays and paid with credit card,this time you have to claim off CAA

But Goldtrail were an agent, so your flights were not booked direct, that's why you had to go through atol/caa for the Goldtrail ones.

Anyway - you've done well to get your money back so fast - still waiting :evil:

Hi Sue,
I checked Atol/CAA on the day it went front page news, rang them to be told to go straight to my credit card company. Rang Tesco who said go back to Atol, told them that Atol instructed me to claim under the section 75 thingymajig. Tesco (masterard) agreed and said they'd send a form out. Over 10 days later it arrived, filled it in and sent it off straight away with all the bumpf and cover letter explaining that I was claiming under section 75. I've phoned them now 3 times and everytime i get the brush off saying "We are dealing with all cases and yours is one of them"

I cannot understand how some credit cards companies are paying up within a week and others take that long to answer the bloody phone. :evil:

Haven't even checked lately about replacement flights as they were silly money last time I looked. I'll wait another few days then give them a buzz. Cannot sort out consequintial losses until I get this money back as it was for 10 flights.

Is anyone else with Tesco and if so have you had a payout?

John ours took 10 days to come through filled the forms in like you about the same time. The only reason ours has taken about 2 weeks is that they wanted to deal with the extra payment at the same time ours should be refunded in the next couple if days. Just keep ringing them I am sure it won't be long now

They paid the flights a couple of days ago but we're still waiting to hear what they're prepared to pay for the consequential losses but wouldn't be surprised if they try to fob us off. Apparently, if they do, you need two letters of refusal before you can go to the Financial Ombudsman.

As I had paid by debit card, had to claim of CAA money was lodged to my account yesterday - a lot quicker than I expected.

Sent my claim for subsequential losses to credit card co.Received a letter today with a load of jargon but the bottom line saying I`m not entitalled to anything.Rang Financial Ombudsman who were very helpfull and are taking the case on but without any promises.

We have got our money back through the credit card and have been lucky enough to replace for reasonably priced flights for May and October next year. Think we have been lucky, cant see many, if any, cheap flights in the future :( :( :(

Just received a letter from Tesco confirming that they will pay the consequential losses in full. Only need to sign the letter to say that we accept the amount and we will be reimbursed. A BIG THANK YOU TO SUE FOR GIVING US THE INFORMATION ON CONSEQUENTIAL LOSSES. :D :D
