Thanks for that Sue, we just got a letter today saying they (Halifax) would credit our account with the amount we paid for flights. But I had not tried to claim the extra £248 extra that its now cost us. I will get in touch with them again.

I am no expert on section 75 but
BOBUK as you booked via Travel Republic who have not gone bust the credit card company is not liable, if you had booked direct and not through an agent you have a claim against credit card company.

What Sue claimed for is ‘Consequential losses' under section 75 her holiday was booked and alternative flights had to be arranged to continue to go on holiday so the credit card company is liable for original flight cost plus additional cost of new flights.
What it does mean is that you do have to try to book the cheapest replacement flight you can from the same airport etc, if you have to go to a different airport because your local airport no longer Operates to dalaman you can claim the cost incurred for return trip to an alternative airport i.e. taxi or fuel cost and parking. If your flight was for 10 days and an alternative is only 7 or 14 you can claim for either 3 lost accommodation nights or the cost of an extra 4 etc
The credit card company will not normally pay this easily and you have to fight stating section 75 and
‘Consequential losses'

thanks for explaining it lost soul, if you dont let the credit card company know of your loss they wont know to pay it and they wont ask you

hi Sue which credit card did you use? i used HSBC and havent heard anything back yet!! didnt know you could claim the difference as ours are £450 more than aegean :x

They will normally say no and hope you go away but you do have the rights, you just have to fight them and ask to speak to someone more senior who has a knowledge of section 75 just don’t give in ultimately the finical ombudsman would side with you, they know that, but the hassle makes people give in. some staff have never been trained on section 75 so have no idea what you are trying to claim for (most know about refunding flights they have had plenty of practice of late)
Some card companies are better then others, some staff more Knowledgeable etc

I had 10 flights booked direct with aegean - paperwork has been sent to Tesco. I'm amazed at how many people have had replies regarding refunds from Tesco, they took 10 days to send out the bloody form. I'm still waiting for a reply, its been well over a week since I sent the bumpf.

Anyway, my holidays were for next August (2012) and we haven't replaced the flights yet as we were holding on a bit for them to stabilise. Are you saying that if we book new flights, for more money than we paid, Tesco visa will also refund the difference.

Ours was Halifax, i do know from experience that HSBC are not really in the know about chargeback and section 75 so it maybe worth chasing them

For group bookings it can be more difficult, if they are all closely related to you state so on the claim form,
If they are friends or non immediate family this can be problematic, but technically you are still covered.

Don’t say your friends etc were paying you back for the flight, it was your treat if you get my meaning as it makes it much more difficult to prove who is part of the credit card contract.

Its a bit catch 22 though as I cannot afford to shell out on another 10 flights until the refund is in place.

Huge thanks to lost soul for the information about "consequential losses" I was certainly not aware of this. Not had any refund back from Capital One as yet although they have received my claim form. I will now be onto them to see if I can make a further claim

I think I've got it. You claim for your lost Aegean flights from cc. You've paid for new flights at an additional cost which you also claim as 'consequential losses.' Both of these are covered by the Consumer Credit Act 1974. If the cc refuses to pay the consequential losses you tell them that you're taking it to the Financial Ombudsman.

Martin Lewis on his website says:
'The law allows you to claim for ‘consequential losses' arising from the problem. In other words, if what went wrong forced you to shell out, the credit card company is liable just like the retailer would be. Obviously it's more difficult to do, but it's still legal'

So if I've understood it right you've paid for new flights but you're only out of pocket for the amount that you paid for your original flight, after your claim has gone through. This would be great if it works out. Fingers crossed :)

you wont be put of pocket in the end, once you get your original money back then you get back the extra you had to pay for your new flights.

If this does come of then it is a fantastic kind of loophole but................

Always the pessemist I have been reading etc and ok if you booked flights for this year and were just about to go away and had to buy new flights last minute so you wouldn't miss your holiday then yes this does seem feasible from what I have been reading but.........

If you have booked flights straight away after the loss of the others for 2012 and they cost an arm an a leg then maybe they would say well you jumped the gun a bit and paid well over the odds and there are new flights out now that are cheap so we will refund the difference to that

I know the way money companies work and they will look to save what they can

I hope not and hope it all comes out good

As far as I know JT it should make no difference, but say you booked with British airways first class and not easy jet then they will only pay you the easy jet price. If the flight with Aegean was £200 pound and flying from Edinburgh and the next best price after Aegean folded was with flythomascook for £500 you claim for the lost £200 then claim "consequential losses" for the extra £300 you had to pay. The list can be endless if you son was going to look after your dog and you then have to move your flight by two weeks because Aegean folded you can then claim for kennels etc.
Keep all paper work, get letters from your son explaining why he can no longer look after the dog, take screen shots of flight prices etc state the flight was the cheapest alternative you could find etc.

John G you can still make a claim after your flights are refunded, when you book new flights put in a claim the only thing they can come back at you with is if flights were readily on sale for say £300 in the weeks Aegean folded and the delay in booking alternative flights meant you paid £500 and the Aegean flight was £200 you should at least get £100 back, but it is there fault they are slow at refunding your money so they should still pay the difference of £300.

edit it makes it easier if you use the same credit card for the new flights

I suppose you're never disappointed when you're a pessimist. So I think it's best not to expect the 'consequential losses' back and if we get it then it's a bonus. We're lucky though, our new flights were only £135 each more from Cardiff ( but we get an extra day out of it and an extra 5 kg extra luggage), but if our flights had been from Bristol they would have been £310 more for each of us. Whatever happens as long as I get to Içmeler I'm happy!

Newcastle gets hit hard, with a double holiday period price increase, Scottish and English holiday times are both counted at Newcastle, they get hit from last week in June to first week in September as peak times.
Huge serge in bookings for this year and next year has increased flight prices high.
Just hope as the demand for flights next year settles down the automated commuter system starts to lower prices.

wish i hadn,t booked with aegean flights now ,they went bust one week after booking,but i have booked again with thomas cook,at a reasonable price. jt has been very helpful.
