You claim from your credit card company. Simply get the booking details of the old and new fllights and send these together with a covering letter saying you are "claiming consequential losses under section 75 of the consumer credit act". There is an example of a covering letter on the moneysavingexpert website or on page 2 of this discussion

I am glad all you have had your refunds when holidays 4u went bust but we are still waiting for refunds from goldtrail to pay out from last year they just keep fobing us off:(

Just a quick question.....

I paid for my initial booking on my credit card but to Travel Republic. Needless to say that the credit card company refused too reimburse me because it was booked with an agent and not H4U directly. My claim is now with the CAA/Huntswood and being dealt with......

Despite the fact that Barclaycard refused to reimburse me due to the above mentioned points, can I legally still claim consequential losses from them at all??

Any help would be appreciated.

Hi Tiberious,looks like we are in the same boat.Same problems with Travel Agent and CC Co..Huntswood will deal with your claim now but you will be able to claim from CC Co. for consequential losses.I claimed after first being refused by CC Co. so I put it it the hands of the Financial Ombudsman who took it on and I was paid in about 3 weeks.Let me know how you come on.

Sent my letter off to cc co for Conseqential losses. That was for flights this year. But I also booked flights for next year on my debit card who do I claim conceqensial losses for debit card payment. Spelling a bid mad. Any help please pat

We paid for the flights we lost by debit card and got a refund reasonably qickly from the CAA. So far as I can make out from the limited research I have done you can only claim for consequential losses if you paid by credit card but if anyone knows anything different please let us know.

hi all have claimed of credit card company for flights and consequential losses we received the money for flights yet despite several phone calls to them they just keep fobbing us off, either they do not appear to know what I am on about or tell me it has been referred to their claims department I have now reported the matter to the financial ombudsman hopefully they will be able to sort it out for me

Hi John we booked with A1 Travel we sent the forms off to the CAA straight away and they are now telling us they are only up to August last year paying out and to do Sep hols it could take until Jan next year, not happy infact angry as they are willing to take your money after they changed our flight then 48 hours after the company went bust, i dont believe that A1 Travel didnt know this

Received consequential losses for new flights for my daughter and her family. Not bad considering we only applied for them on 13th October. I don't think it's worth the risk paying any other way except by credit card in the future even though there are often charges, its just not worth the risk especially with the economy the way it is and the possibility of more companies going into administration.

After reading on various forums that I could claim consequential losses, I made a calim to the credit card company using the standard letter on www.moneysavingexpert.com and this was paid to my account on Friday.

I would urge anyone who paid for new flights after Aegean went bust to submit a claim. It is very easy to do, takes about 10 minutes of your time and the bottom line is you are entitled to this.

Consequential losses only applies if you paid by a credit card, not a debit card, and you had to buy direct from the company that went bust. If you bought from a travel agent (third party) that still trades, then I don't think there's a claim under section 75.

I paid for both my cancelled and new flights with my credit card and booked both through Travel Republic.I claimed consequential losses through my credit card co. and got paid with the help of the Financial Ombudsman.

I'm really surprised you received consequential losses - but well done anyway.

If you buy a holiday via a travel agent and they're simply acting as the middle man, again you lose out. But in instances where they are the tour operator and are selling you a holiday directly, you should be covered.

Hi all,

Just want to let you all know that when I got home from work yesterday, there was a letter waiting from Barclaycard advising that they were crediting my account with £1528.07 in respect of consequential losses! :D I could not believe it. This has paid for next year's flights.

I want to thank you all for sharing this information because I really had no idea I could claim this money back.

Good luck to everyone who is making this claim. Be sure to quote Section 75 of the Consumer Credit Act.
