Its for the additional cost of replacing the holiday.
My 4 original flights were £695 to fly on the 5th August, when H4U went bust on the 3rd, I booked replacement flights to Rhodes and then a ferry to Marmaris, these replacement flights were nearly £1350 so we could go on holiday.
I claimed for my initial flights via my credit card and was refunded the £695 about the 15th of August. When I came back from holiday I read about Consequential losses and section 75 of the credit act on this site. I then made a claim for the additional £655 against my CC and received that back two weeks ago, I forgot to claim for 1 night missed
hotel and €22 for a taxi between Rhodes airport and the port, my friends also received their consequential losses from another CC company including hotel etc.

i received £695 from barclaycard 2 weeks after i made claim how do you claim for other losses i ended up booking package deal £2300 cheers
16 Oct 2011 08:50
Hi Kirky,,,well done. You can claim for "consequential losses",the difference between the original flight costs and the cost of your rebooked ones. Not sure if they will pay for the accomodation though.Write off to Barclaycard. They will probably try to fob you off first,if they do ring the Financial Ombudsman. They are free and excellent.

You can claim only for the flight part plus other losses due to the the failure of AgeanFlights, eg we were unable to use a room for one night which we had to pay for.
You will need your holiday company to give you a breakdown of the package so you can claim like for like of what you lost, I don`t think you can include your
hotel unless you had to pay out for your old hotel, then it has to be of equivilant standard.
Also I believe there is 120 day limit to claim but I may be wrong.

Is anyone still waiting for their refund from the CAA?
16 Oct 2011 15:57
Worth looking into but I think it 6 years you have to make claim
16 Oct 2011 17:24
Just checked, the 120 day rule applies to charge back, my mistake.

Just to clarify - I paid £815 by CC for my original flights with Aegean. A week before we were due to fly they went bust. I made a claim for a refund to Barclaycard. I then purchased new flights at a cost of £2350 to fly on the original date - also by credit card.
When I got home, Barclaycard had refunded the £815.
Am I entitled then to claim the difference (£1535.00) back from Barclaycard????
18 Oct 2011 15:10
Yes,,Brownie1,you can claim the difference back under "consequential losses" from your CC Company. If they wont pay,got to the Financial Ombudsman.
