Hi Dragon,do you mind me asking how you originally booked.With mine there seems to be difficulies because I booked the flights via Travel Republic and not direct with Holidays4U for the first lot and thenThomas Cook for the replacements.

Thomas Cook for the replacements but original flights with Aegean. I think yours is not as straight forward as there's a third party involved and so your contract was with Travel Republic. As I understand it if Travel Republic had gone bust you could have claimed direct from your Credit card.

Thanks Dragon.I have claimed through CAA for the lost flights,it`s the consequential losses I am trying to get via credit card.

I was surprised to have my consequential losses back so easily as I was expecting a battle. Apparently you need two letters of refusal before going to the Financial Ombudsman.

It's definately worth a try but in my opinion from eveything I have read is that you won't get anything as the contract is between the cc company and travel repuiblic which did not go bust therefore there is no liablility under section 75 for the cc company.

I hope I'm wrong

Yes,I already claimed consequential losses on 23/8 from cc company and got reply today.Although its only my first refusal,the Ombudsman was quite happy to go ahead.

Hi there BOBUK i also booked through Travel Republic and still waiting for my money. I paid by debit card which always slows the process down apparenty.
The CAA wrote to me and said all my paperwork was in order but were waiting to hear from Travel Republic so shouldn't be too long i hope.

Thanks for that Billyjoarmstrong.When I completed the CAA forms I had to send them off to Travel Republic first for them to fill in their bits and then forward them on to CAA.Hopefully,they should have all they need.Paying by debit card does seem to take more time.

If the Ombudsman is quite happy to go ahead then that's a good sign. I have used them before on another matter and if you haven't got a case they tell you straight away. As they're willing to get involved already that should cut the time it will take to sort out your claim by quite a bit, I should think. Perhaps it will get sorted quicker than you think as when I did my research I found out that while you don't get charged by the Ombudsman the credit card company will get charged £450. So not only will they have to pay you but have to pay them as well.

Hi Billyjo,,still no word.Travel Republic did send me an email saying they had sent the forms off to CAA.Then about 10 days later got confirmation from CAA.
Off to Turkey tomorrow morning(Calis Beach for a change)8am flight so see what happens when we get home.Will let you know.

Really happy today as I'm flying out to Icmeler tomorrow and Ive also had a letter today from CAA saying my £410 for my previous flights will be in my account within 14 days :D :D :D

My credit card company Capital One have already refunded my flight costs so well done to them. I spoke with them today after getting no where by email. They asked me to fax my new flight details through for 2012 and they will deal with it from there. optomistic as they have not said no

Not sure if I read it here on here on another forum, but if you do take the case to the financial ombudsman, it cost £490. Well this what the credit card company have to pay, we dont pay anything. I am only looking to reclaim just over £200 so it would be much cheaper for them to pay up. if they start playing awkward may just have to threaten them with this

The credit card company gets charged £450 so if they messed you around they could end up paying £650 as they'd have to pay the Ombudsman as well. Quite an incentive to pay out straight away otherwise they have to pay over three times as much. Good Luck with your claim :)

Just opened a letter from my bank regarding my credit card regarding the failure of AegeanFlights

It is worth saying that I made a claim on August the 5th for the original flights I lost that day, I then went on holiday and when I returned on the 22nd they had already refunded my orginal flights for £695.

After catching up with this site and trip advisor and after reading Sue's posts I made my claim for Consequential losses on the 30th of August for the total amount of £687.68 which covers the extra costs of my flights with Easyjet and my ferry from Rhodes, I forgot to claim the €22 taxi in Rhodes and the £35 room charge for the night I missed in Icmeler but never mind.

Any way the letter says that after reviewing my documentation I sent they are willing to settle in full as long as I sign a letter and return it to them within 21 days. What makes me laugh is that the letter I have to sign states that I understand that this offer has been made as a goodwill gesture and I agree that there is no admission of libaility on the part of Lloyds TSB which I suppose is a way of saying that no one can use my refund as a precident but it's section 75 in reality that forces them to pay.

Anyway I'm getting all my money back so I am chuffed to bits, it's going back into the saving account so hopefully we can get away next year.
