Had one refund for lost flights over a week ago. Still awaiting separate claim for flights and 'consequential losses.' Anyone received their refund for the consequential losses yet?

Fingers crossed, Mary. We want to make sure we get the consequential losses before booking the new flights for the booking that we've already had the refunds for. We sent it off on the 22nd August, so early days yet. Will keep you posted.

I'm slightly confused.
If you have not made a new booking there are no consequential losses, or have I missed something.

Two separate bookings and so two separate claims. One for flights only and another for flights plus the consequential losses from booking new flights. Want to see if the claim for consequential losses succeeds before booking new flights for the other booking, which we've already had a refund for the cost of the original flights.

All monies now credited to my card, the ones booked in the last 6 months sorted strait away,the ones over 12 months took 3 weeks.

Tried to claim originally from credit card co. but they said I had to go through CAA which I then did.Rang CAA today and they have received my claim but probably take some weeks to process as they have so many.Sent letter to credit card co. with claim for consequential losses about 10 days ago but no reply as yet.

I sent my claim off to Halifax the day after they went bust, been ringing on a regular basis the only hold up was the consequential costs as they wanted to deal with it as a whole, i got my confirmation in writing on Monday which i had to sign and send back they said it would take a couple of days after that so maybe by the weekend i will have the full amount

We have submitted our claim to cc not heard back yet but only been just over week am I reading right as we had booked for next year can we re-book and claim the difference we have claimed for subsequent losses for the re-booking of this years flights but only reading this thread some of you are claiming for next years flights that were booked anyone let me know if they have rebooked and been reimbursed for next year what would we do without this forum

We've claimed for flights and 'consequential losses' and have found info on these websites helpful

Both of these are covered by the Consumer Credit Act 1974. You'll find a template letter on the second of the websites above.If the cc refuses to pay the consequential losses you can tell them that you're taking it to the Financial Ombudsman.
Martin Lewis on his website says:
'The law allows you to claim for ‘consequential losses' arising from the problem. In other words, if what went wrong forced you to shell out, the credit card company is liable just like the retailer would be. Obviously it's more difficult to do, but it's still legal'
We've claimed for lost flights and consequential losses for one of our bookings which we sent off on 22nd August. Just checked the account and we've been reimbursed today for the flights only so far. Will have to wait for the letter to see what's happening. If they refuse the claim for consequential losses we'll definitely go to the Financial Ombudsman.

A definite thank you for informing us of the 'consequential losses' clause.

Perhaps you could still claim for last year, I thought that the time limit for a claim under the CCA was six years (and for 'chargeback', 120 days), may be wrong but it's worth checking.
I came across some good advice:
Be prepared for the card company to resist paying. Most will automatically reject your first attempt - and even the second attempt - but you should persist with the claim. Threaten to take your claim to the Financial Ombudsman - who are a consumer friendly organisation - should you receive two letters of rejection. If this does not work, it is ALWAYS worth taking your claim to the Financial Ombudsman. Whilst this will not cost you anything, it will cost the card company £450 - which often encourages them to revise their view !
This would be an incentive for them to settle without involving the Financial Ombudsman.

From what I have been reading on holidaytruth complaints there as still lots of people not paid out from the Goldtrail collapse last year who booked through a British travel agency so they may be able to claim too

Can anyone advise?I am confused,to say the least,as to how some members are getting refunds from their CC co. having paid on their cards while others like me,are having to go through CAA.Does it depend on how you book or on the CC Company?

Book direct with h4u/aegean flights with credit card and you claim through credit card (section 75)
Book through an agent/holiday company/third party (not direct with h4u/aegean) with credit card and you claim through Atol/CAA
I'm sure that's what the original Aegean/h4u statement said which was released by the administrators.

if you paid for flights with credit card you can claim back off card if its a package its from the CAA

direct to h4u or one of its trading names (aegean flights)
If you use a third party (travel agent) you need to claim through them or ATOL
